Transparency obligations attach to specific capabilities
Article 50 of the EU AI Act imposes duties that depend on what a system does rather than on how risky it is overall. Interacting with a person triggers a disclosure that they are dealing with an AI system unless it is obvious. Generating synthetic audio, image, video or text triggers a machine-readable marking duty. Emotion recognition and biometric categorisation trigger an information duty to the people exposed to them. A system can carry several of these at once and none of them because it is high-risk, since these obligations run in parallel with the risk classification rather than following from it.
Machine-readable marking is a separate duty from telling the user
Labelling generated content in the interface tells the person looking at it. Marking it in a machine-readable form, through metadata or watermarking, is what allows it to be recognised after it has been downloaded, re-uploaded and stripped of its context, which is where synthetic content actually causes problems. These are different obligations satisfied by different mechanisms, and a product that shows a visible badge has met one of them.
The disclosure has to arrive before the interaction, not after
A notice served at the point a person begins interacting is information; the same notice in a privacy policy is not, because nobody reads a policy before typing into a chat box. Article 50 requires the information to be provided at the latest at the time of the first interaction, and the practical test is whether someone could reasonably not know they are talking to a machine. If they could, the notice is in the wrong place regardless of its wording.

Frequently Asked Questions
When must I tell someone they are dealing with an AI?
At the latest at the time of the first interaction, unless it is obvious to a reasonably well-informed person. A disclosure buried in a privacy policy does not satisfy this because nobody reads one before typing into a chat box.
What is machine-readable marking?
Metadata or watermarking that lets generated content be recognised as synthetic after it has been downloaded and stripped of context. It is a separate duty from showing a visible label, and a visible badge alone satisfies only one of them.
Does this apply if my system is not high-risk?
Yes. Article 50 obligations attach to specific capabilities and run in parallel with the risk classification rather than following from it, so a minimal-risk chatbot still owes the interaction disclosure.
Are there exemptions?
Some. The interaction disclosure does not apply where it is obvious from the circumstances, and marking duties have carve-outs for assistive editing and for content subject to editorial control, which are narrower than they first appear.
